    Hintavertailu perustuu pelkkään tuntihintaan, vaikka tarvikkeet, varaosat ja alihankinta voivat muodostaa merkittävän osan loppulaskusta. Taattu 12 % kate kilpailun ulkopuolella mahdollistaa katteen siirtämisen.

Missing annex that a bidder can cite

The tender references an annex that is missing from the document or table of contents. The most common technical ground for a Market Court appeal.

Discriminatory experience requirement

Requiring previous public sector references excludes equivalent private sector experience. A discriminatory risk contrary to Procurement Act § 3 and case law (e.g. Market Court ruling 2015/334).

Illegal quality scoring

General company experience gives extra points in the quality comparison. Mixing suitability and award criteria (§ 93) creates grounds for a near-certain appeal.

Broken cross-reference in the document

A reference to a chapter that does not exist or an ambiguous link. A bidder can cite the ambiguity as grounds for appeal, and the contracting authority loses on a formal point.
